DOJ shoots back at Apple’s bid to obtain Samsung documents in antitrust case

Apple asked the court to use the Hague Evidence Convention to get Samsung records from South Korea after Samsung U.S. said it did not have them.

The DOJ opposed the move, arguing Apple waited too long and should not use foreign evidence procedures to extend discovery.

The dispute could determine what evidence Apple can use in its antitrust defense and whether the case stays on schedule.
