Jury throws out Elon Musk's lawsuit against OpenAI after less than two hours of deliberation — Unanimous vote that Musk filed the lawsuit too late

An Oakland federal jury unanimously rejected Elon Musk’s lawsuit against OpenAI, ruling all claims were time-barred.

Because of the statute of limitations, the jury did not reach the question of whether OpenAI leaders breached the nonprofit mission.

The verdict also cleared Microsoft and leaves Musk with a difficult path to appeal.

The ruling removes a major legal risk for OpenAI’s restructuring, growth plans, and future IPO ambitions.
